1. About these terms
These Terms and Conditions ("Terms") govern your access to and use of the websites operated by La Prof Virginie ("we", "us", "our"), and any product or service you purchase from us, including online courses, one-to-one coaching, group programmes, and any online community we operate.
By accessing our websites or purchasing any of our products or services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
These Terms are governed by Portuguese law and applicable EU consumer protection law, including Decreto-Lei n.º 24/2014 of February 14 (distance and off-premises contracts) and Lei n.º 24/96 of July 31 (consumer protection).
2. About our services
La Prof Virginie offers a range of educational services in the French language, including but not limited to:
- Pre-recorded online courses sold individually or as part of a subscription.
- One-to-one coaching sessions.
- Group programmes.
- Online community access, where offered.
The specific features, deliverables, format, and price of each product or service are described on the relevant sales page at the time of purchase.
3. Eligibility
You must be at least 18 years old to purchase any of our services. By making a purchase, you confirm that you are an adult and that the information you provide is accurate.
4. Account and access
For some of our services, you will create an account on a third-party platform we use (for example, a course-hosting platform or a community platform). You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.
You may not share your access with anyone else. Each purchase is personal and non-transferable. If we detect account sharing, we reserve the right to suspend or terminate the access without refund.
5. Pricing and payment
Prices for each product or service are displayed on the relevant sales page and on the Stripe checkout page at the time of purchase. Prices may be expressed in different currencies depending on the product.
For subscription products, by providing your payment details you authorise us, through Stripe, to charge your payment method on each billing date until you cancel.
Failed payments will be retried automatically by Stripe. If a payment ultimately fails, your subscription will be cancelled and your access to the service will be revoked.
6. Right of withdrawal
If you are a consumer resident in the European Union or the European Economic Area, you have the right to withdraw from your purchase within 14 days of the contract being concluded, without giving any reason, under Article 10 of Decreto-Lei n.º 24/2014.
To exercise this right, you must send us an unambiguous statement informing us of your decision to withdraw, by email at virginie@laprofvirginie.com. You may use the model withdrawal form set out in Annex B of Decreto-Lei n.º 24/2014.
If you withdraw within the 14-day period and we have not yet begun delivering services to you, we will refund any payment you have made, within 14 days of receiving your withdrawal request.
If you expressly request that the service begin during the 14-day withdrawal period (for example, by attending a live coaching session or downloading course content before day 14), you acknowledge that, by performing the contract in full within that period, you lose your right of withdrawal under Article 17(1) of Decreto-Lei n.º 24/2014. If we have only partially performed the contract by the date of your withdrawal, you will owe a proportionate amount for the services already provided.
7. Cancellation
For subscription services, you can cancel at any time, from your Stripe customer portal (link in any Stripe receipt) or by emailing us. Cancellation takes effect at the end of your current billing period. You will keep access to the service until the end of the period you have already paid for. We do not refund partial months.
For one-time purchases (such as a single course or coaching session), refund eligibility is governed by your right of withdrawal under section 6.
8. Acceptable use
When using our services, you agree not to:
- Harass, threaten, or discriminate against other students, members, or staff.
- Share illegal, defamatory, or sexually explicit content.
- Promote competing services or solicit other students for commercial purposes without our prior written consent.
- Share, record, or distribute our content (videos, course materials, live session recordings) outside the service in which they were provided.
- Attempt to access the service in ways that bypass our payment or authentication systems.
We reserve the right to suspend or terminate any account that violates these rules, without refund.
9. Intellectual property
All content we provide, including videos, course materials, written posts, and the brand and design elements of our websites, is owned by us or licensed to us. You receive a personal, non-transferable, non-exclusive licence to access and view this content for your own personal learning, for the duration of your purchased access.
You may not download, copy, redistribute, or use our content for any commercial purpose without our prior written consent.
Content that you post in any community or shared space we operate (your own posts, comments, and replies) remains yours. By posting it, you grant us a worldwide, royalty-free licence to display it within the service to other members and to use anonymised excerpts for marketing purposes, unless you tell us otherwise in writing.
10. Disclaimers
We do everything reasonable to make sure our services work as described and that the content is accurate and useful. However, we do not promise specific learning outcomes, including any guaranteed level of fluency by a specific date.
The services are provided "as is". We do our best to make them available continuously, but we cannot guarantee uninterrupted access. If a planned live session is cancelled, we will reschedule it or provide a recorded alternative.
11. Limitation of liability
To the extent permitted by Portuguese law, our total liability to you for any claim arising out of or relating to these Terms or our services is limited to the total amount you have paid us in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or loss of opportunity.
Nothing in these Terms limits or excludes our liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be limited or excluded under Portuguese law.
12. Changes to our services and to these Terms
We may change the features included in our services at any time. For changes that materially reduce what you get, we will notify you in advance by email and give you the option to cancel without penalty.
We may also update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. For material changes, we will notify you by email at least 30 days before they take effect.
13. Governing law and disputes
These Terms are governed by the laws of Portugal. The Portuguese courts of the judicial district of Lisbon have exclusive jurisdiction over any dispute arising from these Terms, subject to any mandatory consumer protection rules that grant you the right to bring proceedings in the courts of your place of residence within the EU.
If you are a consumer and you have a complaint, you may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or contact one of the entities listed by the Portuguese Direção-Geral do Consumidor at www.consumidor.gov.pt.
